Articles 370 & 35 A Revoked by Parliament
On August 5,2019 President Ram Nath Kovind issued a constitutional order superseding the 1954 order & making all the provisions of the Indian Constitution applicable to J&K. Article 370 is in part 21 of the Constitution, the heading of which is “TEMPORARY, TRANSITIONAL,& SPECIAL PROVISIONS”.
As per article 370 clause 3, The President may, by public notification declare that this article shall cease to be operative. With issuance of presidential order, the NDA government has resorted to legal interpretations of the Constitutional provisions to do away with Article 370 which granted special status to J&K. In addition the J&K reorganization Act was passed by the Parliament, enacting the division of J&K into two Union territories to be called Union Territory of Jammu & Kashmir and Union Territory of Ladakh.
